Worth noting is that this decision prompted several politicians, including Senator Arlen Spector, to propose legislation limiting the ability of federal judges to bar re-trial by state courts. I don't think this effort went anywhere. Logic tells me that in the absence of such an order, the state would be free to re-try a defendant without implications of double jeopardy attaching.
